PRAYER: Criminal Miscellaneous Petition filed under Sections 389(1) of Criminal Procedure Code, 430(1) BNSS Act, praying to suspend the sentence imposed on the petitioner/appellant by the Judgment dated 02.11.2023 made in Spl.S.C.No.11 of 2015, passed by the learned Sessions Judge, Magalir Neethi Mandram, (Fast Track Mahila Court), Tiruvallur till the disposal of the Criminal Appeal.

ORDER

This Criminal Miscellaneous Petition has been filed by the petitioner, seeking suspension of sentence imposed by the learned Sessions Judge, Magalir Neethi Mandram, Fast Track Mahila Court, Tiruvallur, in Spl.S.C.No.11 of 2015, dated 02.11.2023, and enlarge the petitioner on bail pending disposal of the above appeal.

2.The learned counsel for the petitioner/accused would submit that the petitioner has been falsely implicated in this case; that she is in custody for more than two years; that several arguable points have been raised in the above appeal; and that the co-accused, who is similarly placed has been granted suspension of sentence by this Court, vide order dated 09.10.2025 in Crl.M.P.no.16767 of 2025.

3.Heard the learned Government Advocate (Crl.Side) for the respondent who has filed a counter giving details of the evidence let in by the prosecution.

4.Though the petitioner's earlier petition was dismissed on 10.06.2024, considering the fact that there are substantial grounds raised in the above appeal, which requires consideration; that and since the appeal is not likely to be taken up in the near future; that the petitioner is in custody from 02.11.2023; and that the co-accused who is similarly placed was released on bail, this Court is inclined to grant the relief of suspension of sentence to the petitioner.

5. Accordingly, this criminal miscellaneous petition stands allowed and the sentence imposed on the petitioner is suspended till the disposal of the above criminal appeal and the petitioner is ordered to be released on bail on the following conditions:

(a) the petitioner/accused is ordered to be released on bail, on executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, in which one surety must be a blood related surety, each for a like sum to the satisfaction of the learned Sessions Judge Mahalir Needhi Mandram, FTMC, Tiruvallur.

(b) The petitioner/accused and the sureties shall affix their photographs and Left Thumb Impressions in the surety bonds and the Magistrate may obtain a copy of their Aadhaar Cards or Bank Pass Books to ensure their identities.

(c) The petitioner shall appear before the respondent police on every Saturday at 10.30 a.m., until the disposal of the Criminal Appeal and she shall also appear before the Trial Court on the first working day of every English Calendar month at 10:30 a.m., until the disposal of the Criminal Appeal and if she is not able to appear before the trial Court on any day, she shall make arrangements to file an application under Section 355 of BNSS, 2023 and shall appear before the trial Court on any other day in lieu of the date of her absence, as directed by the trial Court. (d) the de facto complainants are permitted to withdraw Rs. 20,000/- (Rupees Twenty Thousand Only) each, deposited by the petitioner, in S.C.No.11 of 2015, on the file of the learned Sessions Judge Mahalir Needhi Mandram, FTMC, Tiruvallur, on proper identification, in the manner known to law.

(e) the petitioner shall not to have any communication with the victim family.

6.With the above directions, this Criminal Miscellaneous Petition is ordered.
