Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Certiorarified Mandamus calling for the records of the third respondent in proceeding Mu.Mu.A2/441/2025 dated 18.02.2025 and quash the same as illegal and consequently directing the third respondent to transfer the patta in the name of the petitioner and his sister namely Sumithra for the properties comprised S.No.1009/1, S.No.1009/2, S.No.1010, S.No.1012/1J, S.No.1012/1K, S.No.1012/5D, S.No.1012/7, S.No.1012/8, S.No.1012/14, S.No.1012/1F, S.No.1012/15B and S.No.1014/14D situated in Kodakkal Village, then Walajapet Taluk now Sholinghur Taluk, Ranipet District within the stipulated time as fixed by this court.

ORDER

This writ petition has been filed challenging the proceedings of third respondent dated 18.02.2025 and for a consequential direction to third respondent to transfer patta in the name of the petitioner and his sister with respect to the subject property.

2. Heard Mr.K.Venkateswaran, learned counsel for petitioner and Mr.D.Ravichander, learned Special Government Pleader appearing for respondents.

3. This Court carefully went through the order passed by the third respondent. The third respondent has assigned some reasons for not issuing patta in the name of petitioners. The third respondent has also taken into consideration the objections raised by the rival party to the effect that they are in possession of the property. Under such circumstances, this Court cannot exercise its discretion under Article 226 of the Constitution of India to interfere with the order passed by the third respondent. It is left open to the petitioners to file an appeal before the 2/4

second respondent under the Patta Pass Book Act and the same can be considered by the second respondent on its own merits and in accordance with law after affording opportunity to rival parties and a final decision shall be taken within a period of twelve (12) weeks from the date of receipt of fresh representation from the petitioners.
