This Criminal Miscellaneous Petition has been filed by the petitioner/accused seeking to condone the delay of 580 days in filing the appeal in Crl.A.SR.No.86525/2025 against the conviction and sentence imposed on 09.01.2024 in Spl.C.C.No.58/2020 on the file of the Principal Special Court for Exclusive Trial of Cases under POCSO Act, Coimbatore.

2. The learned Government Advocate (Crl.Side) appearing for the respondent Police submitted that he has serious objection to this petition being allowed.

3. The learned counsel for the petitioner/accused submitted that the petitioner/accused has been falsely implicated in this case and now, he is under the judicial custody. He further submitted that the petitioner/accused has a fair chance of succeeding in the Criminal Appeal. Therefore, the learned counsel prayed that this petition may be allowed.

4. Heard the learned counsel on both sides and perused the materials available on record.

5. Considering the reasons stated in the affidavit filed in support of this petition and having regard to the submissions made by the learned counsel for the petitioner/accused, this Court is inclined to allow this petition. Accordingly, delay is condoned and this Criminal Miscellaneous Petition is allowed.
