O R D E R

This criminal original petition is filed to modify the condition imposed by the learned Judicial Magistrate IV, Tiruppur, dated 30.09.2025 in ECMP.No.2924 of 2025 in Crime No.146 of 2025.

The learned counsel for the petitioner would submit that the petitioner is an accused in Crime No.291 of 2025, registered by the respondent for the offences under Sections 123, 274 & 275 of BNS and 7(1) and 20 (2) of the Cigarettes and other Tobacco Products Act, 2003, and Section 59 of the Food Safety and Standards Act, 2006. It is his further contention that the petitioner's Maruthi Suzuki Ciaz Alpha car, bearing Registration No. TN 39 CC 5756, was also seized by the respondent.

3. The learned counsel for the petitioner would further submit 2/6

that the petitioner had filed ECMP.No.2924 of 2025, seeking return of vehicle and the learned Judicial Magistrate IV, Tiruppur, while directing return of vehicle, has imposed a condition that the petitioner should execute a bond for a sum of Rs.12,00,000/- with two sureties of an equal amount to the satisfaction of the Court. It is his further contention that the vehicle is of the year 2017 and the market value of the vehicle will not be more than Rs.2,00,000/-.

4. Therefore, he would pray that the condition imposed by the the learned Judicial Magistrate IV, Tiruppur, to execute bond for a sum of Rs.12,00,000/- is onerous and the same may be modified.

5. Heard the learned counsel on either side and perused the records.

6. Taking into consideration the fact that the vehicle is of the 3/6

year 2017 and the market value will not be more than Rs.2,00,000/-, the condition imposed by the the learned Judicial Magistrate IV, Tiruppur, is modified to the extent that the petitioner shall execute a bond for a sum of Rs.2,00,000/-, with two sureties for an equal amount to the satisfaction of the Court, along with proof of the stated value. Other conditions imposed by the the learned Judicial Magistrate IV, Tiruppur, shall remain unaltered.

7. With the above modification, this criminal original petition is ordered.
