ORDER
This writ petition is filed for a direction to the first respondent to issue No Objection Certificate (NOC) for the petitioners' land in Survey No.398/1 to an extent of Acre 1.00 cents and Acre 1.92 Cents at Agaram Village, Parangipettai Taluk, Cuddalore District.
2. Upon hearing the learned counsel appearing for the petitioners and perused the affidavit filed in support of this petition and the other materials placed on records.
3. The grievance of the petitioners is that, they purchased the property from their vendors and their vendors have clear and absolute title in respect of the same and the encumbrance certificate that has been produced before this Court would show that there has been transactions 2/4
by the private parties right from the year 1920s. In view of the same, suddenly, now the Wakf Board cannot claim title over the same.
4. Per contra, the learned counsel appearing for the Wakf Board would submit that there is a title deed in respect of the Wakf and the property was also entered in the Wakf Register.
5. If that be so, copies of the same shall be furnished by the petitioners. In any event, the petitioners have made a representation to the first respondent on 31.07.2025. The first respondent shall take up the same for enquiry. Let the petitioners also be heard while deciding the issue and it is open for the petitioners to place all such documents at their command before the first respondent. The first respondent shall decide the issue in accordance with law within a period of eight weeks from the date of receipt of a web copy of this order, without waiting for the certified copy of the order.
With these directions, this writ petition is disposed of. No costs. 06.01.2026 mp 3/4
