ORDER

The petitioners, who were arrested and remanded to judicial custody on 07.08.2025, for the offences punishable under Section 109 of BNS and subsequently altered into Sections 103(1) and 61(2) of BNS in Crime No.35 of 2025, registered on the file of the respondent police, seek bail. The earlier bail applications of the petitioners were dismissed by this Court, vide common order dated 08.10.2025 in Crl.O.P.Nos.27087 and 27192 of 2025. 2.

The case of the prosecution is that there is a land dispute between the petitioner/ Chinnappa Reddy - A4 and the deceased, that thereby A4 engaged the petitioner/ Rammaya. A. Ballari Ramakrishnan- A3 and other accused to commit murder of the deceased; that accordingly, the petitioner/ A3 and other accused attacked the deceased using sickle and various other deadly weapons, thereby causing his death. Hence, this case. 3.

The learned counsel appearing for the petitioners submitted that the petitioners have been falsely implicated in this case and they are in judicial custody since 07.08.2025. He further submitted that the co-accused/ E.Santhakumar was granted bail by this Court, vide order dated 10.10.2025 in in Crl.O.P.No.27742 of 2025; and that the petitioners are ready to abide by any 2/4

conditions that may be imposed by this Court and sought for bail to the petitioners.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioners, reiterated the prosecution case and submitted that there are totally four accused involved in this case and the petitioners are arrayed as A3 and A4; that the co-accused was enlarged on bail by this Court by considering the fact that the petitioner therein was not directly involved in the offence and he was not present at the scene of occurrence; that the specific overtact against these petitioners is that on account of land dispute between the deceased and the petitioner/ A4, he engaged the petitioner/ A3 and other accused for murdering the deceased and that the investigation of this case is pending.

I have considered the submissions made on both sides and perused the materials available on record, including the bail order of the co-accused/ E.Santhakumar in Crl.O.P.No.27742 of 2025, wherein it has been specifically stated that the petitioner therein was not present at the scene of occurrence and not having any specific overtact.

Considering the above facts, gravity of offence, the specific overtact against the petitioners herein, which shows that they had actively participated in the offence, there is no change of circumstances after dismissal of the earlier bail applications in Crl.O.P.Nos.27087 and 27192 of 2025 and taking note of the fact that the investigation of the case is pending, this Court is not inclined to grant bail to the petitioners. 7.
