PRAYER To set aside the order dated 13.10.2025 passed in Crl.M.P.No.124/2025 by the Learned Sessions Judge, Special Court for Trial of Cases under SC and ST (POA) Act, Tiruppur and enlarge the appellant on bail, pending investigation of the case in Cr.No.95/2025 on the file of the 2nd respondent, and thus render justice.

ORDER
This Criminal Appeal has filed to set aside the order dated 13.10.2025 passed in Crl.M.P.No.124/2025 by the Learned Sessions Judge, Special Court for Trial of Cases under SC and ST (POA) Act, Tiruppur and enlarge the appellant on bail, pending investigation of the case in Cr.No.95/2025 on the file of the 2nd respondent.
2. Heard the learned counsel appearing for the appellant and the learned counsels appearing for the respondents and perused the materials placed before this Court.
3. The learned counsel for the appellant submitted that the appellant has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions, imposed by this Court.
4. The learned Government Advocate (Crl.Side) submitted that, there are totally 5 accused, in which petitioner is arrayed as A5. A1 to A4 have already been released on bail and the victim has been discharged from the hospital and the investigation is almost completed.
5. Considering the above facts and circumstances, that the investigation is almost completed, this Court is inclined to grant bail to the appellant. Accordingly, the order made in Crl.M.P.No.124 of 2025 dated 13.10.2025 on the file of the Sessions Judge, Special Court for Trial of Cases under SC and ST (POA) Act, Tiruppur, is hereby set aside. This Criminal Appeal stands allowed.
6. The appellant is ordered to be released on bail on her execution of a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties,
each for a like sum to the satisfaction of the learned Sessions Judge, Special Court for Trial of Cases under SC and ST (POA) Act, Tiruppur and on further conditions that:
[a] The appellant and the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity. [b] the appellant shall report before the respondent police as and when required for interrogation.
[c] the appellant shall not abscond either during investigation or trial. [d] the appellant shall not tamper with evidence or witness either during investigation or trial.
[e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the appellant in accordance with law as if the conditions have been imposed and the appellant released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].
[f] If the accused thereafter abscond, a fresh FIR can be registered under Section 269 BNS.
