The petitioner was apprehends arrest at the hands of the respondent police for the offences punishable under Sections 3(1), 4(1) and 5(1)(a) of Immoral Traffic (Prevention) Act, 1956, in Crime No.463 of 2024, on the file of the respondent Police, seeks anticipatory bail.

2. The allegation against the petitioner is that the petitioner joined hands with other accused running a brothel house. Based on information received, the police searched the premises and rescued six victims. Hence, the present case.

3. The learned counsel appearing for the petitioner submitted that the petitioner is innocent and has been falsely implicated in this case. The petitioner is ready and willing to abide by any conditions that may be imposed by this Court hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution and submitted that the investigation in this case is pending.

5. Heard both sides and perused the materials available on record.

6. This Court had already dismissed the anticipatory bail application of the petitioner in Crl.O.P.No.26595 of 2025, dated 26.09.2025, by stating the following reasons:

"4. Per contra, the learned Government Advocate (Crl.Side) reported that the petitioner was aware of the tenants' activities and he was also participated with the same. He also produced the statement of the victim girl. He further submitted that there is one previous case of a similar nature pending against the petitioner. Hence, he opposed to grant anticipatory bail to the petitioner.

5. Considering the nature of offence committed by the petitioner, and taking note of the fact that there is one previous case, similar in nature, pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

6. Accordingly, the Criminal Original Petition is dismissed."

7. Considering the facts and circumstances of the case, and taking into account that this Court, by order dated 26.09.2025, had already dismissed Crl.O.P.No.26595 of 2025 filed by the petitioner, and this is the second anticipatory bail petition with no change in circumstances, this Court is not inclined to reconsider the same.
