ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 69, 351(2) of BNS, 2023, in Crime No.55 of 2025 on the file of the respondent Police, seeks anticipatory bail.

2.The allegation against the petitioner is that he has developed close relationship with 21-year-old victim girl, who is not having her family support, harassed her, and had sexual intercourse under the pretext of marriage. Unable to bear the harassment, she lodged complaint. Hence the case. 3.The learned counsel for the petitioner submitted that the petitioner aged 23 and the complainant aged 21, had a consensual relationship without any promise of marriage. He further submitted that the defacto complainant had harassed the petitioner and taken documents related to his house and other properties, and the complaint was filed with malicious intent. Therefore, the learned counsel seeks anticipatory bail to the petitioner. 4.The learned counsel for the Intervenor submitted that the petitioner had continuously threatened the defacto complainant and sexually assaulted her. Hence, he opposed for grant of anticipatory bail to the petitioner.

5.The learned Government Advocate (Crl.side) for the respondent police reported that the FIR was recently registered, and the investigation is not completed and he opposed the grant of anticipatory bail to the petitioner.

6. I have also gone through the FIR and it reveals various forms of harassment made by the petitioner against the victim which indicates that this is not a consensual relationship case, hence I am not inclined to grant anticipatory bail to the petitioner.
