ORDER

The petitioners, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 305(e) & 326(a) of BNS Act, 2023, in Crime No.257 of 2025, on the file of the respondent Police, seek anticipatory bail.

2. The case of the prosecution is that the petitioners were illegally quarried 1 unit of sand from the lake bund by using JCB and Mini lorry. Hence, the case.

3. The learned counsel for the petitioners submitted that the petitioners have helped the workers of 100 days work scheme (Mahatma Gandhi National Rural Employment Guarantee Act) to remove the bushes in the lake bund and Mini lorry has not been seized and only the JCB has been seized. He further submitted that a false case has been registered against the petitioners and the petitioners were ready to abide by any conditions that may be imposed by this Court. Hence, he prays to grant anticipatory bail to the petitioners.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted that, the petitioners have attempted to smuggle the sand in the lake bund by using JCB and Mini lorry. He further submitted that the investigation is still pending,

hence, he opposed to grant anticipatory bail to the petitioners.

5. Heard both sides and perused the materials available on record.

6. On perusal of records shows that FIR in Crime No.257 of 2025 was registered against the petitioners under Sections 305(e) & 326(a) of BNS Act, 2023. The FIR was registered on 28.09.2025. The JCBs' were seized by the respondent police. The petitioners' contention that they have supported the workers of 100 days scheme is not supported by any materials. Considering the facts and circumstances, this Court is of the view that the petitioners are not entitled for anticipatory bail. Therefore, this Criminal Original Petition is dismissed.
