Writ Petition is filed under Article 226 of Constitution of India praying to issue a Writ of Mandamus directing the respondent to pay the petitioner his terminal benefits such as pension, commuted value of pension, death cum retirement gratuity, encashment of earned leave, etc. pursuant to petitioner being permitted to retire from the service of the respondent on attaining age of superannuation on 31.03.2025 within the time frame.

This writ petition has been filed for a direction directing the respondent to pay the petitioner his terminal benefits such as pension, 1/4

commuted value of pension, death cum retirement gratuity, encashment of earned leave, etc. pursuant to petitioner being permitted to retire from the service of the respondent on attaining age of superannuation on 31.03.2025 within the time frame.

2. Without expressing any opinion on merits of the writ petition, the respondent is directed to consider the request made by the petitioner seeking terminal benefits such as pension, commuted value of pension, death cum retirement gratuity, encashment of earned leave, etc and, after issuance of notice to the petitioner and giving him personal opportunity of hearing, to pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of copy of this order.

3. With the above direction, this writ petition is disposed of. There will be no order as to costs.
