jurisdiction and consequently, direct the fourth respondent to issue patta to the petitioner's land in Survey No.95/5, Re-survey No 95/5D, Town Survey No.9/2, situated at Dhadhagapatti, Salem Town, Salem, in favor of petitioner as per the Registered sale deed in Doc. ORDER
This writ petition has been filed challenging the online rejection order dated 07.04.2025 passed by fourth respondent and for a consequential direction to fourth respondent to issue patta in the name of the petitioner with respect to the subject property.
2. Heard Mr.L.Ramanathan, learned counsel for petitioner and Mr.N.Naveenkumar, learned Government Advocate appearing for respondents.
3. The case of the petitioner is that he is the owner of the subject property by virtue of a sale deed dated 24.02.2025 registered as document No.1117 of 2025. The petitioner submitted an application on 08.03.2025 to fourth respondent seeking issuance of patta in his name 2/4
based on the sale deed.
4. The grievance of petitioner is that an online rejection order has been issued by fourth respondent without assigning any reason and aggrieved by the same, the present writ petition has been filed.
5. In the considered view of this Court, if the fourth respondent wanted to get any clarification from the petitioner, the petitioner ought to have been called for enquiry and thereafter, a reasoned order ought to have been passed. However, an online rejection order has been passed without assigning any reason. The same suffers from violation of principles of natural justice.
6. In the light of the above discussion, the online rejection order dated 07.04.2025 passed by fourth respondent is hereby quashed and the matter is remanded back to the file of fourth respondent with a direction to the fourth respondent to call the petitioner for enquiry and get all the necessary clarifications and thereafter, pass a reasoned order N.ANAND VENKATESH, J.
