(The Order of the Court was made by N.Sathish Kumar) An appeal which is ought to have been filed by the petitioner
-2against the conviction of life imprisonment for the offences under Section 366 IPC, Section 6 r/w 5(m) & 5(i) of Protection of Children form Sexual Offences Act, 2012 and Section 506(ii) of IPC, has not filed in time. There is a delay of 2013 days in filing the appeal. The reason assigned for the delay is that though the matter has been entrusted to a young lawyer to file an appeal, the same has not been filed. Now, the petitioner came to know that the appeal has not filed by the concerned Advocate and there is a delay. Hence, he would pray to condone the delay.
2. Considering the above submission and also considering that the petitioner is undergoing imprisonment, we are inclined to condone the delay. Accordingly, the delay is condoned. This petition stands allowed. Registry is directed to number the appeal if it is otherwise, in order.
