ORDER

The petitioner, who apprehends arrest for the alleged offence under Sections 123, 286 of BNS Act and Section 24(1) of Cigarette and Other Tobacco Products Act, 2003 in Cr.No.197 of 2025 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that A1 was found in illegal possession of 30 pouches of banned tobacco products, each containing 15 packets. It is further alleged that A1 had purchased the said contraband from the petitioner. Hence, the present case. .

3. The learned counsel appearing for the petitioner submitted that he has not committed any such offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prayed that anticipatory bail may be granted to the petitioner.

4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that the petitioner herein has been ranked as A3. It is alleged that he had supplied the banned tobacco products to the other accused persons. He further submitted that 35 kilograms of banned tobacco products were recovered in this case. Hence, he vehemently opposed the grant of anticipatory bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the gravity and nature of the offence alleged against the 2/4

petitioner, and the fact that a huge quantity of contraband was seized from him, I am not inclined to grant anticipatory bail to the petitioner.
