ORDER

This writ petition has been filed seeking issuance of a writ of mandamus directing first respondent to act upon the objections submitted by the petitioner and not to survey the subject property without considering the objections given by the petitioner.

2. Heard Mr.E.Hariharan, learned counsel for petitioner and Mr.D.Ravichander, learned Special Government Pleader appearing for respondents 1 and 2.

3. The case of the petitioner is that by virtue of an earlier order passed by this Court in W.P.No.25341 of 2025, which was filed by third respondent, an attempt was made to survey the subject property. According to the petitioner, he is the absolute owner of the subject property. Therefore, the petitioner submitted objections on 06.10.2025 objecting to the survey. Since the same was not considered, the present writ petition has been filed.

4. In the considered view of this Court, if the petitioner is 2/4

claiming right and title over the property and he is also claiming that joint patta stands in his name in patta No.38681, the first respondent has to necessarily consider the objections submitted by the petitioner before surveying the subject property. Hence, there shall be a direction to the first respondent to deal with the objections submitted by the petitioner and proceed further in accordance with law.

This writ petition is disposed of with the above direction. No costs.
