Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the 2 nd to 4 th Respondent to consider representation dated 01.09.2025 and subsequently to proceed with disbursement of pension, gratuity and other retirement benefits to the petitioner. ORDER

This Writ Petition has been filed seeking a direction to the second and fourth respondents to consider the representation dated 01.09.2025 and to proceed with the disbursement of pension, gratuity and other retirement benefits to the petitioner. 2/6

2.Heard the learned counsel appearing on either side and perused the materials available on record.

3.The petitioner submitted a representation seeking terminal benefits before the fourth respondent. On receipt of such representation, the fourth respondent submitted a proposal to the third respondent. However, the third respondent returned the proposal for want of some defects. 4.A perusal of the records reveals that the third respondent raised an issue regarding the wives of the petitioner. Even assuming that there is a dispute between two wives, the petitioner, who retired from service, is very much alive and is entitled for the benefits. Only after the life time of the petitioner would any question regarding the entitlement of the wives arise. 5.In view of the above, the fourth respondent is directed to resubmit the 3/6

proposal seeking terminal benefits of the petitioner before the third respondent within a period of two weeks from the date of receipt of a copy of this order. On receipt of such proposal, the third respondent is directed to consider the same and disburse the terminal benefits to the petitioner within a period of two weeks thereafter.

6.With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
