O R D E R

This Criminal Original Petition has been filed seeking a direction to the Judicial Magistrate, Avinashi, to expedite the speedy disposal of Crl.M.P.No.22 of 2025.

2. The learned counsel for the petitioner submitted that the petitioner had lodged a complaint against one Arul Prasad Senniappan, with the Avinashi Police Station in C.S.R.No.346 of 2024. However, no action was taken and

thereafter, the case was closed as a mistake of fact. The said information was served on the petitioner on 09.09.2024. Subsequently, the petitioner submitted a representation to the Inspector of Police on 20.09.2024. As no action was taken thereafter, the petitioner filed a complaint under Section 223 before the Judicial Magistrate, Avinashi on 02.10.2024. Though now a Crl.M.P.No.22 of 2025 has been assigned, no order has been passed till date. Hence, the present petition.

3. On the submissions made and upon perusal of the materials on record, it is seen that the petitioner has filed a private complaint along with nine documents and a list of two witnesses. However, the Judicial Magistrate, Avinashi, has not yet considered the petitioner's complaint or passed any order and the case has been pending from 02.01.2025 till 26.11.2025 for enquiry.

4. In view of the above, the trial Court concerned is directed to conclude the enquiry and pass appropriate orders on the petition filed by the petitioner, without any delay, preferably within a period of three months from the date of receipt of a copy of this order.

5. Accordingly, this Criminal Original Petition is allowed. 22-04-2026 AT
