ORDER

This Writ Petition has been filed challenging the order passed in G.O. (D) No. 980 dated 22.08.2025, Health and Family Welfare Department, thereby imposed punishment of stoppage of increment for a period of five years with cumulative effect.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner was qualified with B.D.S. Degree and selected for Government Service at Thoothukudi Medical College and Hospital and subsequently, she was transferred to Kilpauk Medical College and Hospital, Chennai on 28.07.2018. While she was working at Thoothukudi Medical College and Hospital, she was advised to clear the Account test for Executive Officers and Medical Code, which was conducted twice in every year. She had appeared for the said examination and she failed to clear the Account test. However, she has given fake document as if she had passed in Account Test for Executive Officers. So, she was declared that she had completed her probation period.

But, on verification, it was found that the petitioner had produced a fake document and she was served on with a charge memo framing two charges, which are as follows :- "Charge No.1 Dr.I.G.Kanimozhi, who works as an Assistant Medical Officer (DEIC) at Government Kilpauk Medical College Hospital without clearing/passing the Accounts Examination test for Executive Officers conducted by the Tamil Nadu Public Service Commission, has submitted a false report (TNPSC Bulletin) claiming that she has passed the said test and has requested to declare the completion of her probationary period. By this act, she has deceived the Government and has failed in the integrity of the Medical Profession".

Charge No.2 By the above act, the doctor has violated Rule (20) of the Tamil Nadu Government Servants Conduct Rules."

Thereafter, enquiry was conducted and as per the enquiry report, the petitioner was served on with show cause notice for the proved charges and she was imposed with punishment of stoppage of increment for a period of five years with cumulative effect.

4. On seeing the facts, it is seen that the petitioner has committed very serious charge and also violated the procedures contemplated under Rule 20 of Tamil Nadu Government Servant's Conduct Rules. So, the petitioner was rightly imposed with the punishment of stoppage of increment for the period of five years with cumulative effect. Hence, this Court finds no illegality or infirmity in the impugned order passed by the 1 st respondent and it also does not require interference of this court.

5. In the result, this Writ Petition stands dismissed. No costs. Consequently, connected Writ Miscellaneous Petitions are closed. 06-11-2025 4/6
