Prayer : Writ Petition filed under Article 226 of Constitution of India praying for issuance of Writ of Mandamus, directing the 5th respondent to shift the petitioner in old pension scheme under Tamil Nadu Pension Rules 1978 as per this Honble High Court order, Dated 03.07.2023 passed in WP.No. 8726 of 2022 and the Full Bench order of this Honble High Court, dated 03.12.2019 in WA.No. 158 of 2016 etc., (Batches) and consequently allot General Provident Fund Number and transfer the deducted amount from the petitioners salary to respective GPF and Pension Accounts maintained under Tamil Nadu Pension Rules 1978 and pay the pension under Tamil Nadu Pension Rules, 1978 by considering petitioner representation dated 08.10.2025. ORDER
This Writ Petition has been filed seeking a direction to the fifth respondent to shift the petitioner to the old pension scheme under Tamil Nadu Pension Rules 1978, in terms of the order passed by this Court in W.P.No. 8726 of 2022 dated 03.07.2023 and the order passed by the Full Bench of this Court, in W.A.No. 158 of 2016 etc. batch, dated 03.12.2019 and consequently to allot a
General Provident Fund Number, transfer the amounts deducted from the petitioner's salary to the respective GPF and Pension Accounts maintained under Tamil Nadu Pension Rules 1978 and to pay the pension under the said Rules, by considering the petitioner's representation dated 08.10.2025. 2.Heard the learned counsel appearing on either side and perused the materials available on record.
3.Without expressing any opinion on the merits of the writ petition, the fifth respondent is directed to consider the request made by the petitioner for shifting to the old pension scheme in the light of the order passed by this Court in W.P.No. 8726 of 2022, dated 03.07.2023, and the order of the Full Bench of this Court in W.A.No. 158 of 2016 etc. batch, dated 03.12.2019, and to allot a General Provident Fund Number, transfer the amounts deducted from the petitioner's salary to the respective GPF and Pension Accounts maintained under Tamil Nadu Pension Rules 1978 and to pay the pension under the said Rules, within a period of eight weeks from the date of receipt of a copy of this order.
4.With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
