Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to call for the records relating to the impugned order of the second respondent in Na.Ka.No.A1/ 18/2025 dated .09.2025 and quash the same and direct the 1/5
respondents to regularize the period of suspension as duty period and grant all consequential benefits to the petitioner.

ORDER
This Writ Petition has been filed challenging the order passed by the second respondent, thereby suspended the petitioner from duty. 2.Heard the learned counsel appearing on either side and perused the materials available on record.
3.The petitioner was appointed as Shop Supervisor in the TASMAC. While being so, on 28.08.2025, an inspection was conducted and the inspection team found that the liquor bottles were sold at an excess price of Rs.10/- per bottle. Based on the inspection report, the second respondent suspended both 2/5
the salesman and the petitioner.
4.The only contention raised by the petitioner is that, on the date of inspection, he was on leave due to stomach pain. He also produced a medical certificate dated 29.08.2025. However, the petitioner failed to produce any leave letter either prior to 28.08.2025 or immediately thereafter. It shows that the petitioner created the medical records only for the purpose of escaping from the clutches of law.
5.In view of the above, this Court finds no infirmity or illegality in the order of suspension passed by the second respondent. However, the petitioner submitted a representation seeking revocation of the order of suspension on the ground that the amount which was allegedly collected in excess was remitted by the salesman. Therefore, the second respondent is directed to consider the representation submitted by the petitioner and pass appropriate orders on merits and in accordance with law, within a period of two weeks from the date of receipt of a copy of this order.
