PRAYER Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of Mandamus, directing the respondents to allow the petitioner to rejoin his duty based on the representation of the petitioner dated 10.09.2025.

ORDER

This Writ Petition has been filed for a direction directing the respondents to allow the petitioner to rejoin duty based on his representation dated 10.09.2025.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner joined as a Junior Assistant in the Ponneri Revenue Divisional Office on 16.12.2011 on compassionate grounds. Thereafter, he was transferred to the Tiruvallur District Collectorate and was again transferred to Valasaravakkam on 15.04.2015. Subsequently, on 16.06.2015, the petitioner 2/6

was transferred to the Tiruvallur Taluk Office as a Special Revenue Inspector (Civil Supplies). However, he did not join duty there due to certain family problems.

4. After his family issues were resolved, the petitioner submitted several representations during the years 2019-2022 requesting permission to rejoin duty. Subsequently, the 2nd respondent directed him to undergo a medical examination, and as per the medical report, he was found fit to join service. Based on the said report, the 2nd respondent forwarded a communication dated 24.09.2024 to the 1st respondent seeking clarification as to whether the petitioner may be permitted to rejoin duty. The said communication is currently pending before the 1st respondent.

5. In view of the above, the 1st respondent is directed to pass orders on merits and in accordance with law on the communication dated 24.09.2024 sent by the 2nd respondent, within a period of 8 weeks from the date of receipt of a copy of this order.
