Respondent Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to pay the difference amount of terminal benefits such as gratuity and earned leave salary, as per the 14th wage settlement along with 18% per annum interest for the belated period of terminal benefits to the petitioner within stipulated time as may be fixed by this Court.

ORDER
This Writ Petition has been filed seeking a direction to the respondent to pay the differential amount of terminal benefits, such as gratuity and earned leave salary, as per the 14th wage settlement, together with interest at the rate of 18% per annum for the belated period of terminal benefits due to the petitioner.
2. Heard the learned counsel appearing on both sides and perused the materials available on record.
3. The petitioner was working as a Special Grade Driver in the first respondent Corporation and retired from service on 28.02.2020 on attaining the age of superannuation.
4. A settlement was entered into between the Union and the Management on 01.09.2019, which was made applicable with effect from 24.08.2022. Therefore, the petitioner is also entitled to the benefit under the said settlement, dated 01.09.2019. However, his terminal benefits were settled without reference to the terms of the said settlement. Hence, the petitioner is entitled not only to the differential amount in terminal benefits, but also to interest for the delayed payment.

5. This stand of the petitioner cannot be disputed. Therefore, the respondent is directed to pay the differential amount of terminal benefits, such as gratuity and earned leave salary, as per the wage settlement dated 01.09.2019. The said amounts shall be paid within a period of six weeks from the date of receipt of a copy of this order. The respondent shall also pay the differential amount with interest at the rate of 6% per annum, to be computed from the date of the petitioner's retirement till the date of actual payment.
6. With the above said observations, this Writ Petition stands disposed of. No costs.
