..Respondent Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the respondent to consider the representation dated 10.08.2022 and 23.08.2022 made subsequent to order dated 05.09.2017 by this Court in Writ Petition No.18969 of 2017, and consequently direct the respondents to refund to the petitioner, the tax amount of Rs.7,78,720/- and compounding fees of Rs.2000/- as directed by this Court in Writ Petition No.18969 of 2017, together with interest at the rate of 24% per annum from the date of expiry of twelve weeks from the date of receipt of the order dated 05.09.2017 until the date of actual realization. ORDER

Mr.TNC.Kaushik, learned Additional Government Pleader takes notice for the Respondent.

2. This Writ Petition is being disposed of at the stage of admission itself with the consent of the learned counsel for the Petitioner and the learned Additional Government Pleader for the Respondent.

3. The learned Additional Government Pleader for the respondent fairly concedes that the petitioner's representation dated 10.08.2022 will be considered and appropriate orders will be passed on merits within a period of three months from the dated of receipt of a copy of this order.

4. Recording the above submission made by the learned Additional Government Pleader for the respondent, the writ petition is disposed of by directing the respondent to consider the petitioner's representation dated 10.08.2022 and pass appropriate orders on merits, in accordance with law, within a period of three months from the date of receipt of a copy of this order, after affording an opportunity to the petitioner.

5. This Writ Petition stands disposed of with the above observations. No costs.
