O R D E R

This writ petition has been filed for a direction forbearing the respondents from evicting the petitioners from the subject property pending the appeal before the Commissioner of Land Administration.

2. Heard both sides and perused the materials available on record.

3. In the considered view of this Court, the petitioners have filed an appeal on 17.07.2025 before the Commissioner of Land Administration, against the proceedings of the District Collector, dated 06.06.2025. The said order resulted in the cancellation of the assignment. The petitioners have also moved a stay petition. Since the same was not considered and in the meantime, steps were taken to evict the petitioners, the present petition has been filed before this Court to forbear the respondents from evicting the petitioners pending disposal of the appeal before the 1st respondent.

4. It is now too well settled that this Court will not exercise its jurisdiction under Article 226 of the Constitution of India, when a substantial dispute is pending before the authority concerned. Writ jurisdiction cannot be invoked only 2/4

for the purpose of getting an interim order, when the substantial dispute is pending before the competent authority. In view of the same, the relief as sought for by the petitioners cannot be granted.

5. Opportunity is granted to the petitioners to move an interim application before the Commissioner of Land Administration and the same shall be dealt with on its own merits and in accordance with law. The writ petition is disposed of in the above manner. No costs. Connected W.M.P. is closed.
