ORDER
In this writ petition, the petitioners claim that ineligible persons have been given benefit by giving allotments in the Scheme of free house site patta for Washerman (Dobhi) and Nakuliyars (Barber) community.
2. The petitioners claim that they are eligible to be allotted free house site patta in the aforesaid scheme. Since the petitioners' representation seeking for
allotment of pattas in their respective names have not been considered, the petitioners have filed this writ petition.
3. In the affidavit filed in support of this writ petition, the petitioners have disclosed the name of the persons, who, according to the petitioners are ineligible to be awarded free house site pattas under the scheme.
4. The learned Special Government Pleader appearing for the respondents would submit that if a fresh representation is given by the petitioners, disclosing the name of the persons, who, according to the petitioners are ineligible to get free house site pattas as per the scheme, and the request is made by the respective petitioners for issuance of free house site pattas in their respective names under the scheme, the said representation will be considered on merits and in accordance with law within a time frame to be fixed by this Court.
5. No prejudice would be caused to the respondents if the aforesaid direction is issued by this Court.
6. This Court is not expressing any opinion on the merits of the petitioner's case.
7. For the foregoing reasons, this writ petition is disposed of by directing the petitioners to submit a fresh representation to the first respondent seeking for inclusion of their respective names as beneficiaries in the scheme of free house site pattas for Washerman (Dobhi) and Nakuliyars (Barber) community and to allot and issue the free house site pattas to the respective petitioners within a period of two weeks from the date of receipt of a copy of this order. In the said representation, the petitioner shall also disclose the names of the persons, who, according to the petitioners, though not eligible, have been identified by the first respondent as beneficiaries under the scheme.
8. On receipt of the said representation, within the stipulated time, the first respondent shall pass final orders on merits and in accordance with law
within a period of twelve weeks thereafter.
9. In the event that the first respondent finds that ineligible persons have been allotted free house sites under the scheme after giving due consideration to the petitioner's representation, the petitioner is granted liberty to challenge the same in the manner known to the petitioner under law. 08-12-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes ab
