ORDER

This writ petition has been filed challenging the order passed by the second respondent in Ka.No.320/NiBi.2/U Th.3/Ko.O.p/2025-1 dated 10.09.2025, thereby rejecting the request made by the petitioner seeking family pension on the demise of her son.

2. Heard the learned counsel for the petitioner and perused the materials available on record.

3. The petitioner's son had worked as Line Man in the respondents' Board. While he was in service, died on 14.02.2019. He got married with one K.Chandra and gave birth to a daughter. Subsequently, due to misunderstanding, their marriage was dissolved by an order dated 31.01.2005 in HMOP.No.154 of 2004 by the Principal Subordinate Judge, Erode. Now, his unmarried daughter is surviving. While being so, the petitioner, who is the mother of the deceased son submitted an application seeking family pension.

4. It is relevant to rely upon Rule 49 (6)(iii) of the Tamil Nadu Pension Rules as follows:-

"49. Family Pension:- (6)(iii) In the case of an unmarried daughter, until she attains the age of (Twenty Five Years) or until she gets married whichever is earlier."

5. Thus, it is clear that in case of an unmarried daughter, until she attains the age of twenty five or until she gets married whichever is earlier, she is entitled to get family pension. Admittedly, the petitioner's daughter is an unmarried girl and she is entitled for family pension.

In view of the above, the claim made by the petitioner was rightly rejected and this Court finds no infirmity or illegality in the order passed by the second respondent in Ka.No.320/NiBi.2/UTh.3/Ko.O.p/2025-1 dated 10.09.2025 and the writ petition is devoid of merits and is liable to be dismissed. The respondents are directed to disburse the family pension to the unmarried daughter of the deceased, forthwith.
