.. Respondents This Writ Petition is filed under Article 226 of the Constitution of India,

praying for the issue of a Writ of Certiorarified Mandamus, calling for the records relating to the registration certificate dated 16.6.2003 certifying the name of the society as Nadar Peravai under Registration No.186 of 2003 on the file of the Registrar of Societies, Chennai-Central, Seethamma Colony, Chennai 600 018 (the first respondent herein) and to quash the same and directing the respondents to change the name of the second respondent Society any other name not resembling or identical or mere to the name of Tamil Nadu Nadar Peravai. O R D E R

The learned counsel appearing for the writ petitioner, on verification, informed this Court that the suit filed by the parties concerned in C.S.No.833 of 2002 is pending even today. But it is represented that the suit was field prior to the registration of the second respondent-Society by the Registrar under the Act.

2. May it that be, the civil suit between the parties is still pending and it is left open to all the parties concerned to adjudicate the suit through documents and evidences and the dispute can be resolved only by way of the civil suit.

3. In view of the pendency of the civil suit, no adjudication on the ground raised in this writ petition, is to be considered by this Court and

accordingly, the writ petition stands dismissed, however, there shall be no order as to costs. Consequently, connected miscellaneous petition is also dismissed. 30-06-2017 Speaking Order/Non-Speaking Order Index : Yes/No.
