ORDER

This criminal original petition has been filed to call for the records pertaining to FIR No.34 of 2025, dated 24.02.2025, on the file of the first respondent and quash the same.

2/5 2.The learned counsel for the petitioner submitted that the FIR has been filed with an ulterior motive on account of the personal animosity; there is absolutely no evidence to support the FIR; since the eight accused in this case preferred a complaint before the Gachibowli Police Station, Cyberabad, Telangana, against the second respondent herein, which was registered in Crime No.15 of 2025 on 03.01.2025, the present case has been given against the petitioner and others as a counter blast and absolutely, there is no material to proceed as against the petitioner.

3.The learned Government Advocate (Crl.Side) submitted that the petitioner is the Accounts Manager of the de facto complainant's two firms; the petitioner, during the course of employment, by falsification of accounts and fabrication of the documents, had diverted the funds due to the de facto complainant's company; he and the other accused have also committed fraud by diverting the funds of the company and several amounts have been wrongly diverted through bank deposits and to the G-Pay accounts of the wife of the petitioner, other employees and wife of the other employees; investigation is in

3/5 the initial stage; there are prima facie materials available in this case; apart from that, the accused have also, out of the proceeds of crime, purchased several properties and the respondent police are taking steps with regard to that aspect also.

4.Mr.Arun Anbumani, learned counsel for the second respondent/de facto complainant submitted that the second respondent's complaint is the first complaint; on coming to know about the falsification of the accounts, diversification of funds and criminal misappropriation done by the petitioner and other staff in the company, the de facto complaint has preferred a complaint on 31.12.2024 and FIR No.34 of 2025 was registered on 24.02.2025; the total amount defrauded amounts to Rs.20 crores; on coming to know about the complaint, the petitioner, with the help of the eighth accused, as a counter blast, had registered the complaint before the Gachibowli Police Station, Cyberabad, Telangana; there are several materials to show that the petitioner, along with the other accused, has, in a calculated manner, committed offences and thereby, he would object for quashing the FIR against the petitioner.

4/5 5.Heard the learned counsel for the petitioner, the learned Government Advocate (Crl.Side) for the first respondent and the learned counsel for the second respondent/de facto complainant.

6.Taking into consideration the submissions made on either side, the fact that investigation is in the initial stage and that there are prima facie materials as against the petitioner, this Court is not inclined to grant the relief sought by the petitioner.

7.Accordingly, this criminal original petition stands dismissed. Consequently, connected miscellaneous petition is also closed.
