ORDER
This criminal miscellaneous petition is filed to relax the condition that the petitioner should report before the respondent police on the first working day of every English calendar month, imposed vide order dated 29.04.2025 passed in Crl.O.P.No.13709 of 2025, on the file of this Court.
2. This Court, in Crl.OP.No.13709 of 2025, by order dated 29.04.2025, had imposed the following condition:
"3.Considering the submissions on either side and the nature of offence, this Court directs that the petitioner shall appear before the respondent police on the first working day of every English calendar month until the filing of the additional report. On such filing, the petitioner shall appear before the respondent police as
and when required for interrogation."
3.When the matter is taken up for hearing today, the learned Government Advocate (Criminal Side), would submit that preliminary charge sheet in CC.No.7 of 2022 has been filed. He would further submit that the respondents have filed an application for further investigation and the Special Court under the TNPID Act, 1997, has also granted permission for further investigation and the investigation is pending.
4.Heard the learned counsel on either side and perused the records. 5.Taking into consideration the fact that further investigation is pending and that the petitioner is also not an accused as per preliminary charge sheet, this Court is inclined to modify the condition to the effect that, the petitioner shall appear before the Trial Court in the event of issuance of summons. It is made clear that the petitioner shall give his correct address to the respondent police and he shall appear before the respondent police as and when required by them, for further investigation.
