O R D E R

This writ petition has been filed challenging the patta that has been issued in favour of the respondents 5 to 7 and for a direction to the 4th respondent to restore the patta in favour of the petitioner with respect to the subject property.

2. In the considered view of this Court, if the petitioner wants to cancel the patta issued in the name of the respondents 5 to 7, he has to make a representation to the 3rd respondent seeking cancellation of patta and to restore the patta in his 2/4

name. Instead, the petitioner cannot challenge the patta issued in favour of the private respondents directly in a writ petition.

3. In the light of the above discussion, liberty is granted to the petitioner to make a fresh representation to the 3rd respondent along with all the relevant documents. On receipt of the same, the 3rd respondent shall deal with the same on its own merits and in accordance with law, after affording opportunity to the respondents 5 to 7 and final orders shall be passed, within a period of eight weeks from the date of receipt of fresh representation from the petitioner. With the above direction, this writ petition is disposed of. No costs. Connected W.M.Ps are closed.
