ORDER

This writ petition has been filed for issue of writ of mandamus directing the respondents to deal with the representation made by the petitioner on 28.04.2025, wherein, the petitioner is seeking for issuance of patta with respect to the subject property.

2.Heard Mr.B.Manoharan, learned counsel appearing on behalf of the petitioner and Mr.C.Jayaprakash, learned Government Advocate appearing on behalf of respondents 1 to 3.

3.The case of the petitioner is that one Ettiyappan was the auction purchaser of the subject property by virtue of a registered Sale Certificate registered as Document No.5449 of 2004. The said Ettiyappan demolished the structure and vacant land was sold in favour of the petitioner. The petitioner has approached the respondents seeking for issuance of patta. Since the same was not considered, the present writ petition has been filed before this Court.

3/9 4.It is seen from records that the representation made by the petitioner was forwarded by the District Collector to the Tahsildar by communication dated 03.06.2025.

5.In view of the above, there shall be a direction to the 3rd respondent to deal with the representation made by the petitioner and pass appropriate orders on its own merits and in accordance with law, within a period of four weeks from the date of receipt of copy of this order. If there are any other interested parties, orders shall be passed after affording opportunity. 6.This writ petition is disposed of with the above directions. Today, the matter was listed under the caption "for being mentioned" on the ground that there is an inadvertent mistake that has crept in, in paragraph No.5 of the order. Therefore, paragraph No.5 of the order dated 31.10.2025 shall read as follows :

"5. In view of the above, there shall be a direction to the respondents 2 and 3 to deal with the representation made by the petitioner and pass appropriate orders on its own merits and in accordance with law, within a period of four weeks from the date of receipt of copy of this order. If there are any other interested parties, orders shall be passed after affording opportunity."

2. Registry is directed to carry out necessary correction in the order and issue fresh order copy.
