The present Criminal Original Petition has been filed seeking to quash the proceedings pending against the petitioner in Spl.S.C.No.34 of 2025 on the file of the learned Sessions Judge, Special Court for trial of cases under SC/ST Act, Namakkal.

When the matter was taken up for hearing today, the learned Government Advocate (Criminal Side) submitted that the trial in this case has commenced and seven out of twelve witnesses have been examined. 3.

Learned counsel appearing for the petitioner submitted that despite the request made by the petitioner for adjournment, the trial Court proceeded to examine the seven witnesses on the same day. He further submitted that the petition filed seeking permission to recall those witnesses is still pending before the trial Court.

Heard both sides and perused the materials available on record.

Taking note of the facts of the case and the submissions made by the learned Government Advocate (Criminal Side) that the trial has already commenced and seven witnesses have been examined, this Court is not inclined to interfere at this stage.

In view of the above, the Criminal Original Petition stands closed. However, the learned Sessions Judge, Special Court for trial of cases under SC/ST Act, Namakkal, is directed to give sufficient opportunity to the petitioner for cross-examining the witnesses so as to ensure fair trial. Consequently, the connected miscellaneous petitions are closed. 4/6
