PRAYER To call for the records and set aside the order dated 09.09.22025 passed in Crl.MP.9157/2025 in Cr.No.56/2024 by the Learned Metropolitan Magistrate for Exclusive Trial of CCB Cases and CBCID Metro Cases, Egmore, and pass such further or other orders at this Honble Court may deem fit and proper in the circumstances of the case and thus render justice. ORDER

This case is listed under the caption for 'being mentioned' at the instance of petitioner's counsel.

2. The learned counsel for the petitioner submits the petitioner was appointed by NCLT as Interim Resolution Professional. This court by an order dated 28.10.2025, directed the Trial Court to hand over the car to the petitioner. But, when the petitioner approached the Trial Court for take over the car, the Trial Court insisted the petitioner to execute the surety. The petitioner is Interim Resolution Professional not an accused and this case is not like other cases. Hence, he prays to give directions to the Trial Court to hand over car without insisting for sureties.

3. The duty is cast upon the petitioner to take over the properties and hand over to NCLT. Hence, the Trial Court is directed to permit the petitioner to take

over the car without any surety.
