ORDER

This Criminal Original Petition has been filed to direct the learned CCB and CBCID Magistrate, Egmore, Chennai, to dispose of C.C.No.4630 of 2023, on its file within the time stipulated by this Court.

2/5 2.When the matter was taken up for hearing today, the learned Government Advocate (Crl.Side) would submit that there are totally 15 witnesses in this case, out of whom, 2 have been examined and the case stands posted on 10.12.2025 for further progress.

3.The Apex Court in the case of Sangram Sadashiv Suryavanshi Vs. The State of Maharashtra in Criminal Appeal No.4758 of 2024 dated 25.11.2024, has observed that the High Courts are fixing time-bound schedule for conclusion of trial in a routine manner, despite the decision of the Constitution Bench of the Supreme Court in the case of High Court Bar Association, Allahabad vs. State of Uttar Pradesh reported in (2024) 6 SCC 267, which reads as under:

"47.3. constitutional courts, in the ordinary course, should refrain from fixing a time-bound schedule for the disposal of cases pending before any other courts. Constitutional courts may issue directions for the timebound disposal of cases only in exceptional circumstances. The issue of prioritising the disposal of cases should be best left to the decision of the courts concerned where the cases are pending."

3/5 4.However, taking into consideration the fact that there are only 13 more witnesses, the learned Trial Judge is directed to dispose of C.C.No.4630 of 2023, as expeditiously as possible, preferably within a period of one (1) year from the date of receipt of a copy of this order. 5.Accordingly, this Criminal Original Petition stands disposed of. 29-10-2025 Index:Yes/No Speaking/Non-speaking order Internet:Yes sli To 1.The CCB and CBCID Magistrate, Egmore, Chennai.
