This Criminal Original Petition has been filed to transfer the investigation alleging that a false complaint has been filed against the petitioner/accused.

The learned counsel appearing for the petitioner would submit that on the basis of the false complaint given against the petitioner, he was arrested and released on bail. He would further submit that the petitioner had sent a representation to the Investigating Officer to delete his name from the First Information Report in Crime No.27 of 2025 on the file of the second respondent. As the second respondent has not taken any steps, the present petition has been filed seeking transfer of investigation from the second respondent to any other agency.

3. The learned Government Advocate [Criminal Side] appearing for the respondents, on instructions, would submit that the present case has been registered in the month of June 2024. The allegation against the petitioner is that the petitioner is an accused in an online scam and on the compliant given by one Swetharanyan, that a sum of Rs.22,30,74,368/- has been cheated and a sum of Rs.50 lakhs has been transferred to the account 2/5

of the petitioner and no satisfactory explanation has been given by the petitioner with regard to the transfer of the amount to his account, the aforesaid FIR has been registered. It is his further submission that no sustainable or legitimate reasons have been stated by the petitioner for transfer of investigation. In support of his contentions, he had relied upon the judgment of the Supreme Court in Arnab Ranjan Goswami Vs. Union of India and others reported in [2020] 14 Supreme Court Cases 12.

Taking into consideration the fact that the petitioner had not raised any legitimate ground for transfer of investigation and that a sum of Rs.50 lakhs has been transferred to the account of the petitioner and no satisfactory explanation has been given by the petitioner with regard to the transfer of the said amount to his account, this Court is not inclined to transfer the investigation.

5. Accordingly, this Criminal Original Petition stands dismissed. 05.01.2026 vrc 3/5
