ORDER

The Revenue Divisional Officer, Tiruvallur, is suo motu added as the fifth respondent in this Writ Petition. Mr.N.Naveenkumar, learned Government Advocate, takes notice for the impleaded fifth respondent.

2. This writ petition has been filed seeking issuance of a writ of mandamus directing the second respondent to deal with the representation made by the petitioner on 28.06.2025 and to pass orders within the time frame fixed by this Court.

3. Heard Mr.P.Manikannan, learned counsel for petitioner and Mr.N.Naveenkumar, learned Government Advocate appearing for respondents 1 to 3 & 5.

4. The case of the petitioner is that she is one of the co-owner of the subject property and that the property originally belonged to her father in whose name the patta was issued in Patta No.1216. After the 2/4

demise of the father, the petitioner's brother has managed to get patta exclusively in his name. Aggrieved by the same, the petitioner submitted a representation before the second respondent seeking cancellation of patta and for issuance of patta by adding the name of the petitioner also. Since the same was not acted upon, the present writ petition has been filed.

5. Under the Patta Pass Book Act, it is only the Revenue Divisional Officer, who is the competent authority to deal with the issue raised in this writ petition. Therefore, liberty is granted to the petitioner to submit a fresh representation before the fifth respondent/ Revenue Divisional Officer, Tiruvallur, seeking cancellation of patta and for issuance of patta by adding her name in the patta, along with relevant documents and also a copy of this order. The fifth respondent, on receipt of the fresh representation, shall deal with the same on its own merits and in accordance with law after affording opportunity to fourth respondent and pass orders within a period of eight (8) weeks from the date of receipt of the fresh representation from the petitioner.
