ORDER
This writ petition is filed seeking a direction to the first respondent to consider the representation of the petitioners dated 29.09.2025.
2. The petitioners are senior citizens aged 67 and 65 years respectively, residing at the above mentioned address. They have one son and two daughters, all of whom are married. Their elder son, aged 46 years, passed away due to a heart attack on 19.03.2025, leaving behind his wife, S.Karthiga, the 2 nd respondent herein and their two children.
3. During the period of grief following the death of their son, the 2 nd respondent had demanded division of property. On 15.05.20225, while the 1 st petitioner was away from home, the 2 nd respondent allegedly assaulted the 2 nd __________Page 2 of 7
petitioner and attempted to snatch her jewellery. Hence, the petitioners lodged a complaint at the Salem Town Police Station on 16.05.2025 and C.S.R. No. 100 of 2025 was issued. However, no investigation or further action has been taken by the police authorities till date.
4. Subsequently, the petitioners filed O.S.No.317 of 2025 before the Additional District Munsif Court, Salem seeking a permanent injunction. The nd respondent, in turn, filed a false theft complaint against the petitioners' daughter, Vanitha and her husband at the Salem Town Police Station in Crime No.13 of 2025, which was closed as "mistake of facts" on 02.08.2025. The 2 nd respondent filed another complaint under the Protection of Women from Domestic Violence Act, 2005, before the District Social Welfare Office on 15.07.2025. Further, the 2 nd respondent and her mother have occupied the deceased son's office in the commercial complex, thereby preventing the petitioners from carrying on their business, which is their only source of income and was established using the hard-earned money of the 1 st petitioner.

Being senior citizens facing continuous harassment, threats and disruption to their livelihood, the petitioners submitted a detailed representation dated 29.09.2025 to the 1 st respondent under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. However, no action has been taken to date. Hence, the petitioner is before this Court seeking a mandamus to the respondents to consider their representation.
6. Heard the learned counsel appearing for the petitioners and the learned Special Government Pleader appearing for the first respondent.
7. Considering the above facts and circumstances of the case, this Court directs the respondents to consider the representation of the petitioners dated 29.09.2025 and pass a speaking order within a period of one month from the date of receipt of a copy of this order, after affording an opportunity of hearing to the interested parties.
