ORDER

This Writ Petition (Criminal) has been filed to direct the 1 st respondent forbearing in terms of the Circular No.18/ADGP/L and O/CAMP/2024 Dated 09.01.2024, the 2 nd and 3 rd respondents from interfering in civil issues pertaining to matrimonial affairs, in the pretext of inquiry on the basis of the complaint lodged by the 4 th respondent.

2. When the matter is taken up for hearing today, the learned Government Advocate (Crl. Side) appearing for the respondents police submitted that based on the complaint lodged by the 4 th respondent/wife of the petitioner in respect of matrimonial cruelty, non returning of her jewels and threatening her to give divorce, enquiry is being conducted by the 3 rd respondent police. He further submitted that the complaint was filed very recently i.e. on 05.10.2025 and the rd respondent police has intended to forward the complaint to the All Women Police Station, Karur. Further, in view of the specific allegations made in the

complaint, the said circular dated 09.10.2024, will not be applicable to the present case and that the respondents police are not harassing the petitioner.

It is seen that the 4 th respondent is said to have given the complaint on 05.10.2025 in respect of allegations of matrimonial cruelty and non returning of her jewels, which cannot be termed as civil in nature. Further, it is reported by the learned Government Advocate (Crl. Side) that since it is a case of matrimonial dispute, the 3 rd respondent police has intended to forward the same to the All Women Police Station, Karur, for enquiry.

4. In such view of the matter, the police concern is directed to conduct enquiry. However, it is made clear that the petitioner shall not be unnecessarily harassed and needless to state, for the purpose of conducting enquiry, due process by issuance of summons shall be undertaken.
