ORDER

This Criminal Original Petition has been filed to set aside the order dated 01.08.2025 passed in C.M.P.No.2125 of 2025 by the learned Principal Sessions Judge, Salem and consequently to relax the condition imposed in Crl.M.P.No.1629 of 2025 dated 09.06.2025 on the file of the Principal Sessions Judge, Salem.

2. Learned counsel for the petitioner submitted that the petitioner was granted anticipatory bail vide order dated 09.06.2025 in CMP No.1629 of 2025, by the learned Principal Sessions Judge, Salem. The petitioner has complied with the condition from 11.6.2025 to 28.09.2025. Thereafter, the petitioner was not able to comply the condition, due to his ill health. Hence, the petitioner has filed a petition in Crl.M.P.No.2125 of 2025 under Section 483(1)(b) of BNSS, before the Principal Sessions Court, Salem, to relax the bail condition. However, the said relaxation petition has been dismissed. Hence, now the 2/5

petitioner has filed this criminal original petition to set aside the order dated 01.08.2025 made in C.M.P.No.2125 of 2025 by the learned Principal Sessions Judge, Salem and also to relax the condition imposed in the said Crl.M.P.No.1629 of 2025.

Considering the facts and circumstances of the case that the petitioner had complied with condition from 11.6.2025 to 28.09.2025 and thereafter the petitioner failed to comply with the condition due to his ill health and also considering the nature of offence, this Court is inclined to relax the condition.

4. Accordingly, order dated 01.08.2025 passed by the learned Principal Sessions Judge, Salem in C.M.P.No.2125 of 2025 is setaside and the said condition imposed in Crl.M.P.No.1629 of 2025 dated 09.06.2025 is relaxed. 28-10-2025 mfa Index:Yes/No Speaking/Non-speaking order Internet:Yes 3/5
