ORDER

The petitioner, who was arrested and remanded to judicial custody on 02.10.2025, for the alleged offence punishable under Section 24(1) of Cigarette and other Tobacco Products Act, 2003 r/w. 123 of BNS in Crime No.408 of 2025, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused was found in possession of 15 kgs of banned tobacco products.

3. The learned counsel for the petitioner submitted that the petitioner was added as an accused only based on a confession, and no recovery was made from the petitioner and he is in custody from 02.10.2025. Hence, he prayed for grant bail to the petitioner.

4. The learned Government Advocate (crl.Side) appearing for the respondent police reported that recovery was also made from this petitioner and he has also produced the a seizure mahazar. He further submitted that he is involved in four previous cases of a similar nature. Hence, he opposed for grant of bail to the petitioner.

5. Considering the fact that the petitioner is having bad antecedents and the the property recovered from this petitioner, I am not inclined to grant bail to the petitioner.
