Respondents Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorari, Calling for the records relating to the order of suspension passed by the 2nd respondent in Na.Ka.No. 502/2025/R-1 dated on 18.09.2025 and quash the same.

ORDER

This Writ Petition has been filed challenging the order of suspension dated 18.09.2025 passed by the second respondent.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner was appointed as Shop Supervisor in the second respondent Corporation. While he was on leave from 23.08.2025 to 25.08.2025, an inspection was conducted on 24.08.2025, during which, it was found that the salesman had sold the liquor bottles with excess amount of Rs.10/- per bottle. The petitioner, being the Supervisor, was issued a show cause notice. Though the petitioner submitted an explanation stating that he was on leave from 23.08.2025 to 25.08.2025, the same was not considered and the petitioner was placed under suspension.

4. In view of the above, the order of suspension cannot be sustained, since the petitioner was not present in the TASMAC shop on the date of inspection. Further, the impugned order also did not even whisper about when the liquor bottles were sold by excess amount of Rs.10/-.

5. In view of the foregoing discussions, the order impugned in this writ petition cannot be sustained and is liable to be set aside. Accordingly, the order of suspension passed by the second respondent is hereby set aside and the Writ 2/4

Petition is allowed. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
