ORDER

The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Section 304 of BNS, 2023 in Crime No.875 of 2024, on the file of the respondent Police, seeks anticipatory bail.

2.The allegation against the petitioner is that on 10.09.2024 at about 08.10 pm when the de-facto complainant was returning to her home, the petitioner joined hands with other accused waylaid her and snatched her gold chain. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has no previous case. He further submits that the petitioner is ready to abide any condition imposed by this Court. Therefore, the learned Counsel prays for grant of anticipatory bail to the petitioner. Page Nos.2/4

4. The learned Government Advocate (Criminal Side) appearing for the respondent, reiterated the prosecution case and submits that the snatched chain of the de-facto complainant recovered from the arrested accused. He further submits that the petitioner is having 13 previous cases. Hence, he opposed for grant of anticipatory bail to the petitioner.

5. Taking note of the fact that the gravity of offence committed by the petitioner and though it is stated that the snatched gold chain recovered from the arrested accused; that the petitioner is having 13 previous cases, this Court is not inclined to grant anticipatory bail to the petitioner.
