O R D E R

The petitioner herein apprehends arrest at the hands of the respondent police for the offences punishable under Sections 123 of BNS, 2023 and 6, 7 and 24(1) of the Cigarette and other Tobacco Products Acts, 2003 in Crime No.373 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. The case of the prosecution is that on 23.09.2025, when the respondent police were on their patrol duty, at that time this petitioner has attempting to transport 124.075 kgs of banned tobacco products and committed the alleged offence and that the respondent police has seized above said banned tobacco products from the petitioner along with the vehicle from the occurrence place. Hence the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police submitted that the investigation has been completed. He 2/4

would further submit that the huge quantity of tobacco products has been seized from the petitioner. Hence, he strongly opposed the grant of anticipatory bail to the petitioner.

5. Heard the learned counsels on either side and perused the materials available on record.

6. Considering the nature and gravity of offence and the fact that huge quantity of tobacco products has been seized from the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, this Criminal Original Petition is dismissed. 27.10.2025 kmm 3/4
