ORDER

This writ petition has been filed for the issue of writ of Mandamus directing the 2nd respondent to consider the representation made by the petitioner on 09.12.2024 wherein the petitioner has sought for the cancellation of the sub-division patta issued in the name of the 4th respondent for the subject property. 2.

Heard Mr.Vimal B Crimson, learned counsel for the petitioner and Mr.N.Naveen Kumar, learned Government Advocate for respondents 1 to 3.

The case of the petitioner is that the petitioner's grand father had purchased the subject property in the year 1970 and

thereafter, there was a partition among the family members on 29.10.1985 and the partition deed was also registered as Document No.1462/1985. By virtue of this partition deed, the petitioner was allotted an extent of 57 cents in Survey No.136/7. 4.

The grievance of the petitioner is that a sub-division patta has been issued in the name of the 4th respondent by including the property belonging to the petitioner. Hence, the petitioner submitted a representation dated 09.12.2024 to respondents 1 to 3 to conduct an enquiry and to cancel the sub-division patta in the name of the 4th respondent with respect to the subject property. Since the same was not acted upon, the present writ petition has been filed before this Court.

Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the 2nd respondent to deal with the representation made by the petitioner on 09.12.2024 on its own merits and in accordance with law, after affording opportunity to the 4th respondent and final orders shall be passed within a period of eight weeks from the date of receipt of a copy of this order.

This writ petition is disposed of with the above directions. No costs.
