O R D E R
The petitioner, who was arrested and remanded to judicial custody on 18.09.2025 for the alleged offence under Section 409 of IPC in Crime 1/6
No.14 of 2025 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that the petitioner is the wife of A1 and they have jointly induced the defacto complainant to invest money in the business i.e., manufacture and delivery of machine meant to extract oil and collected to the tune of Rs.1,40,42,000/-. Subsequently, the petitioner neither deliver the machine nor returned the money. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner herein has ranked as A2 and she was not a partner in the business run by A1. Further she has not benefited from the money collected by A1. She is only a wife of A1 and the alleged occurrence took place in the year 2022 and the complaint registered recently. Hence, he prays to grant bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and submitted there are two accused involved in this case and both of them were arrested and this petitioner is also benefited from the money collected by her husband and also transferred the said funds in her account. Hence, he opposed to grant 2/6
bail to the petitioner.
5. Heard both sides and perused the materials available on record.
6. I have gone through the records which revealed that the alleged occurrence took place in the year 2022 and the petitioner is neither a partner nor in the management of the business and further she is a lady and she is in incarceration from 18.09.2025.
7. Considering the above facts and circumstances of the case, I am inclined to grant bail to the petitioner with certain conditions.
8. Accordingly, the petitioner is ordered to be released on bail on her executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, for a like sum to the satisfaction of the learned Judicial Magistrate-I, Tiruppur and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety 3/6
ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;
[b] the petitioner shall report the respondent police daily at 10.30 a.m., for a period of three weeks and thereafter as and when and required for interrogation;
[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 25.10.2025 Vv Note :
