Respondent Prayer : Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondent to review the suspension order vide D.O.No.580/2019 Rc.No.H1/25527/2018 dated 05.08.2019 as per the Government order vide G.O.Ms. No 81, Human Resources Management (N) Department, dated 04.08.2022, and G.O (D) No 450 Municipal Administration and Water Supply Department dated 01.08.2023 and by considering the representation dated 24.09.2025.

ORDER

This Writ Petition has been filed challenging the order of suspension 1/4

dated 05.08.2019.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner was appointed as Grade-II Constable on 01.03.2002 and was subsequently promoted as Head Constable on 01.03.2017. While being so, a complaint was lodged against certain officials of the petitioner's police station and an FIR was registered. Though the petitioner's name was not implicated as an accused, after completion of the investigation, his name was added in the charge sheet, which was taken cognizance in Spl.C.C.No.2 of 2019 on the file of the Special Court for Trial of Cases under Prevention of Corruption Act, Salem. Immediately after the filing of the charge sheet, the petitioner was placed under suspension. Now, the trial is under progress. While being so, the petitioner submitted a representation seeking revocation of the suspension order and the same has not been considered so far.

4. In view of the above, the respondent is directed to consider the 2/4

request made by the petitioner for revocation of the suspension order, in the light of G.O.Ms.No.81, Human Resources Management (N) Department, dated 04.08.2022, and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.

5. With the above direction, this Writ Petition stands disposed of. There shall be no order as to costs.
