ORDER

The petitioner, who was arrested and remanded to judicial custody on 27.09.2025, for the alleged offence punishable under Sections 123 and 275 of BNS and sections 7(1) and 20(2) of COTP Act in Crime No.992 of 2025, on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that he joined hands with other stocked 537.800 kgs of banned tobacco products in the premises of A2. While they were loading the contraband in the car the police intervened and seized the product. Hence the case.

3.The learned counsel for the petitioner submitted that the petitioner is ranked as A3 and he is only provisional shop owner and he is in custody from 27.09.2025.Hence, he prays grant of bail to the petitioner. 4.The learned Government Advocate (Crl.Side) appearing for the respondent police reported that while the contraband was transported from the house of A2, the police on information went there and seized the contraband and arrested all the three accused red handedly. He further submitted that investigation in this case is pending. Hence, he opposed to grant bail to the

petitioner.

5. Considering the fact that the petitioner involved in possession and transportation of 537.800 kgs of banned tobacco products and investigation is pending, hence I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original petition is dismissed.
