Respondents in Both W.Ps Prayer in W.P.No.29880 of 2013: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Declaration, declaring the regulations framed by the 2nd respondent University as communicated by their letter dated 03.09.2003 in so far as it prescribes that a candidate should

have passed all the exams within three semesters even if he had secured 65% of marks which is the qualifying marks for first class as unreasonable and consequently hold that the Petitioner is deemed to have passed in M.E.exam in 1st class because he had secured 65% marks in aggregate award costs.

Prayer in W.P.No.29881 of 2013: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Declaration, declaring the norms prescribed by the 1st respondent AICTE as published in The Hindu dated 22.11.2002 that a candidate should possess first class whether it be at the graduate level or Post Graduate level for appointment as Lecturer in an Engineering College as illegal and in violation of Article 14 of the Constitution of India and consequently hold second class in M.E would be equivalent to first class in B.E for such appointment award costs.

2.In view of the same, both the writ petitions are dismissed as withdrawn. No costs. Consequently, connected miscellaneous petition is also closed.
