O R D E R
The petitioners, who were arrested and remanded to judicial custody on 07.08.2025 for the alleged offence under Sections 103(1) BNS @ 191(2), 61(2), 103(1) of BNS in Crime No.181 of 2025 on the file of the respondent police, seek bail.

The allegations against the petitioner is that due to money dispute, while the deceased was riding in a two wheeler, the petitioners along with other accused travelling in TATA ACE goods vehicle and dashed against the deceased two wheeler, after the deceased fell down from the vehicle and thereafter A1 and A3 have attacked the deceased with Aruva. Hence, the present case.

The learned counsel appearing for the petitioners submitted that the petitioners are ranked as A4 and A5 and totally there are five accused involved in this case and only three persons were shown as accused in the first information report and the allegations is also only against A1 to A3 and there is no allegations against these petitioners even in the subsequent investigation, it revealed that these petitioners have accompanied with A1 to 2/7
A3 and travelled in the goods vehicle. The petitioners are in custody from 07.08.2025 and prays to grant bail to the petitioners.
4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that investigation is not completed. Hence, he opposed to grant bail to the petitioners.
6. Heard both sides and perused the materials available on record.
7. I have also gone through the statements recorded from the witness and the confession statement of the accused, it revealed that these petitioners were travelled in a goods vehicle. However, the petitioners herein have not attacked the deceased and it is also stated by the learned counsel for the petitioners that without knowing the intention of the other accused, the petitioners herein were travelling with A1 to A3 and further the major part of the investigation is also concluded and these petitioners have no previous case.

8. Considering the overt act and the facts stated above, I am inclined to grant bail to the petitioners with certain conditions.

Accordingly, the petitioners are ordered to be released on bail on their executing bonds for a sum of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties, for a like sum to the satisfaction of the Judicial Magistrate Court-II, Namakkal and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;
[b] the petitioners shall stay at Katpadi and report before the Inspector of Police, K1 Katpadi Police Station, Vellore at 10.30 a.m., until further orders;
[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions 4/7
have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 25.10.2025 Vv Note :
