ORDER

This petition has been filed seeking a direction to the 1st respondent to dispose of the petitioners representation dated 07.02.2025 to dismiss the 2nd respondents administration who have been illegally running the association for over a year without conduct election in a lawful manner under the 1st respondents supervision and until then, take appropriate action to ensure that bank accounts.

2. It is the case of the petitioner that the petitioner is the owner of the Flat No.A-111, Sreevatsa Platinum Apartments, Thadagam Road, Edayarpalayam, Coimbatore. The petitioner is a member of the second respondent Association and he paid maintenance and other charges to the second respondent till date. The second respondent's Association registered under the first respondent's office vide Registration No.249/2013 and running the same in the above mentioned from 2013 onwards and present having 72 members in the said association. The first respondent had visited and inspected the second respondent's association on 08.03.2023 and 28.11.2023 respectively and submitted the inspection report dated 28.11.2023 by the first respondent. Based on the same, the second respondent has not acted upon. However, the first respondent has not taken any action as against the second respondents association. The petitioner sent a representation to the first respondent on 07.03.2025. Till date, no action is taken. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

The learned Government Advocate appearing for the first respondent submitted that as per Section 36(1) of the Tamil Nadu Registration Act, the Registrar can initiate an inquiry into a registered society's constitution, working and financial condition under certain circumstances. These include acting on their own initiative receiving an application from a least one-third of the society's total members, or if requested by the District Collector. The petitioner is a single person. However, the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for both side and perused the materials available on record. Since no adverse order is passed against the second respondent, notice to them is dispensed with.

Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the first respondent to consider and pass orders on the petitioner's representation dated 07.02.2025 strictly in terms of the Tamil Nadu Societies Registration Act within a period of twelve weeks from the date of receipt of a copy of this order, after providing

opportunity to necessary parties.
